    Bad Criminal Defense Attorney

    Will not return calls or emails. Got me a deal with the state that seemed good, but that deal has now been changed by the state. Anything I can do?

    You're going to have to be more specific. Have you signed a plea agreement? What did the agreement say and what's changing? Appointed or hired attorney?

    Unless the attorney has informed you he/she has quit and withdrawn with the court, he/she still represents you through sentencing.

    Hired attorney. I signed an agreement, and I agreed to complete a class as part of probation. They added another class a week after. Both my attorney(not my attorney the guy he sent) and some probation officer told me I just had to complete one class and I would be done.

    Well, what does your plea agreement say? Unless the class is super burdensome or expensive, just take it and move on.

    Is it deferred adjudication or have you been sentenced? If you've been sentenced, there's no withdrawing. But I suppose you can refuse to take the class, violate probation and see what happens. I suspect your total jail time, including being held pending a hearing, will increase.

    I'm always surprised by the people that take long probation sentences instead of a little jail time. I had a DWI a long time ago when I was 21 where I was offered 2 years probation and the 3 month class. Did 5 days in County instead and was done with it. Didn't want to have probation hanging over my head for two years with the risk of screwing up, or to pay all the fees.
    County isn't so bad, just kind of a summer camp for losers.

    ^^ agreed. i wasn't offered the option, but i'd have snatched that up in a heartbeat. 5 days vs 18 months of walking/driving on eggshells, not drinking, not smoking, paying probation fees, going to probation office every month, going to aa meetings every week? easy decision.

    I think most attorneys just assume that their client would rather do probation than any jail time.
    My sentence was 15 days, but days in city and county jail were two for one. I ended up with four days credit for my arrest since I was booked at 11:30pm and let out the next day. So for my sentence I just had to go to county on the date that I chose before 4pm, and they let me out at 12:01AM four days later. At that time of my life I was almost certain to mess up probation since drinking is forbidden, so a long weekend in jail was a way better option. Plus all of the other bull$#@! that probation entails that you have mentioned.

    I'll bet you signed up for

    -a specific class, and
    -evaluation plus counseling as recommended by probation (the second class)

    and that's what you got.

    Now how well that was explained to you, or how much you paid attention, I wouldn't know. Some attorneys do a $#@!ty job of explaining things. Some clients don't do a real good job of listening or following instructions.

    I'm confused. If you do the jail time like some of y'all did doesn't that leave you with a record as opposed to deferred adjudication wiping the slate clean if you're clean for whatever period it runs?

    I think most of the people taking jail time were looking at something like a DWI where there is no deferred.

    deferred adjudication for a dwi isn't the same as deffered adjudication for a speeding ticket. it's still on your record after the fact.

    There is no deferred adjudication for DWI.

    Also, for a few offenses, deferred adjudication means nothing, because the case is not subject to non-disclosure and/or can still be used for enhancement. And even non-disclosure doesn't make the case entirely go away.

    A lot of people just want to get on with their lives. Spending a few days or even weeks in county and coming out with a misdemeanor conviction is favorable to living under the thumb of a probation officer for a year or two with the risk of messing up and getting a longer jail sentence hanging over you.

    Deferred adjudication - you are on probation, if you violate you could go to jail, judge defers adjudication (convicting you) while on probation and if you meet the terms the case is dismissed with no conviction. Regular probation - you are on probation, if you violate you could go to jail, you are convicted when the judge pronounces sentence. In Texas, there is no deferred adjudication for DWI so if you go on probation then you are convicted. The idea of taking jail time over probation here is that you will be convicted of the crime anyway and a short jail stint may be preferable to a long probation sentence.

    Same here. But they didn't offer me the option to take the jail time. So had to do a year probation, which sucked. The money you have pay every month, meeting them every month and all the other classes and junk you have to do. Not to mention you can't do anything at all that could get you in trouble. You are so paranoid. It was a beating.

    This is correct. Except in the last decade or so, the Lege has caught on to the deferred adjudication deal and made it a conviction for a lot of purposes. e.g. "second offense" penalty enhancements, etc.
